The Ace Karts website is owned and operated by Harcourt Drive Pty Ltd trading as Ace Karts.

In these Terms, “Ace Karts”, “we”, “our” and “us” refer to Harcourt Drive Pty Ltd ABN 87 868 160 452. “You” and “your” refer to the individual whose information we collect and hold for our purposes, and any person who makes, manages, pays for, or participates in a booking.

By accessing, browsing, or using this website, making a booking, purchasing a service, registering as a member, attending Ace Karts, or participating in any race session, you agree to these Terms and Conditions as amended from time to time.

Ace Karts may amend these Terms and Conditions at any time. Changes take effect immediately upon posting to our website. Continued use of the website, attendance at Ace Karts, or participation in any service constitutes acceptance of the amended Terms.

1. Safety, instructions and participation

Go-karting is an active motorsport activity. By participating, you acknowledge that it involves inherent risks, including impact, sudden stops, loss of control, collision with other karts or barriers, and injury.

All drivers and attendees must follow Ace Karts’ safety briefing, track rules, signage, staff directions, and any instructions given before, during, or after a race session. Failure to follow instructions may result in removal from the premises or cancellation of racing without refund, credit, postponement, or fee waiver.

• Drivers must wear all required safety equipment correctly.
• Long hair and loose clothing must be secured before racing.
• Phones, cameras, loose items and valuables must not be taken onto the track unless approved by Ace Karts.
• Bumping, reckless driving, deliberate contact, erratic swerving, ignoring lights or flags, or unsafe behaviour is not permitted.
• Ace Karts may slow, disable, remove, or stop any kart or session where safety requires it.

2. Fitness to race

Drivers must be physically and mentally fit to participate. You must not race if you are affected by any condition, injury, illness, medication, impairment, or other circumstance that may affect your ability to drive safely or follow instructions.

Ace Karts may refuse participation if we reasonably believe a person may not be fit to race, may pose a risk to themselves or others, or may be unable to safely follow instructions. No refund, credit, postponement, or fee waiver will apply where participation is refused for safety reasons.

3. Race sessions and delays

Due to the dynamic nature of go-kart racing, sessions may occasionally be delayed for a range of reasons, including safety matters, incidents, weather, operational requirements, track conditions, mechanical issues, or delays caused by other customers.

We make every effort to ensure race sessions start on time, but start times are estimates only and may change. Ace Karts is not liable for any loss, inconvenience, travel cost, missed appointment, or other expense caused by session delays.

4. Birthday offer

The Ace Karts birthday offer entitles the birthday recipient to a free race upgrade. Eligible customers may upgrade from 1 race to 2 races, or from 2 races to 3 races.

To qualify:

• You must already have an Ace Karts profile.
• You must present your birthday message at reception on arrival.
• The offer is valid for 30 days from your birthday.
• Bookings must be made by phone in advance and are subject to availability.
• The offer applies only to the birthday recipient.
• The offer is not transferable, redeemable for cash, or redeemable as credit.

The birthday offer cannot be used on its own and only applies as a free upgrade to a paid race package. If you fail to present the birthday message or attempt to transfer the offer, it will be forfeited. Ace Karts reserves the right to change or withdraw this offer at any time without prior notice.

5. Cancellations, refunds and credits

[fs-toc-omit] 5.1 Exclusive Race and Bucks reservations

• Cancellations must be submitted in writing via our Refund Request Form.
• Cancellations made 14 days or more before the reservation date will receive a full refund, less a 10% administration fee.
• Cancellations made within 14 days of the reservation will not be refunded.
• Refunds are processed within 7 business days of cancellation approval.

[fs-toc-omit] 5.2 Arrive and Drive reservations

• Cancellations must be submitted in writing via our Refund Request Form.
• Cancellations made 7 days or more before the reservation time will receive a full refund, less a 10% administration fee.
• Cancellations made within 7 days of the reservation will not be refunded.
• No refunds are provided if fewer drivers participate than were originally booked.

[fs-toc-omit] 5.3 Reduced driver numbers, no-shows and credits

If fewer drivers attend than originally booked, the unused spots are forfeited. No refund, credit, or postponement will be provided for unused spots where notice was not provided in advance.

Customers must notify Ace Karts in advance of any cancellation or reduction in driver numbers. A minimum of 3 days’ notice is required for reduced driver numbers to be considered for credit.

Credits are issued at Ace Karts’ discretion, are not guaranteed, are non-transferable, and cannot be redeemed for cash.

All credits are applied to the customer’s Ace Karts profile and may only be used by the customer or booking profile they were issued to, unless otherwise approved by Ace Karts management. Credits cannot be transferred, sold, exchanged, gifted, or used by another person without written approval from Ace Karts.

[fs-toc-omit] 5.4 Third-party suppliers

Additional cancellation fees may apply if less than 72 hours’ notice is given, as per third-party supplier terms. Any third-party costs already incurred by Ace Karts may be deducted from any refund or credit otherwise available.

6. Payments and credit card policy

Full payment for Exclusive Race and Bucks bookings must be received before racing. Failure to pay the balance will result in forfeiture of your deposit and race sessions, and the remaining balance may be charged to the original payment source where permitted.

Ace Karts reserves the right to sight the credit card used for online transactions and request identification or other verification. Failure to provide reasonable verification may result in cancellation of your booking without refund where Ace Karts reasonably suspects fraud, misuse, or unauthorised payment.

Prices, products, fees, packages, and availability may change without notice. A booking is not confirmed until payment is received and confirmed by Ace Karts.

7. Arrival requirements

All drivers must arrive 30 minutes before their session. Late arrivals may miss their sessions, and race schedules cannot be delayed where this impacts the day’s operations.

Failure to arrive on time, failure to complete required registration or briefing requirements, or failure to attend will result in cancellation without refund, credit, or postponement.

8. Alcohol and drug policy

Ace Karts enforces a zero tolerance policy of 0.00 BAC. If we suspect that a driver is under the influence of alcohol, drugs, medication, or any substance that may affect their ability to race safely, they will not be permitted to race.

No refunds, credits, postponements, or fee waivers will apply where a customer is refused participation under this policy.

9. Weather policy

[fs-toc-omit] 9.1 Wet weather

Races proceed as planned in wet weather conditions. Wet weather alone does not entitle a customer to a refund, credit, or postponement.

[fs-toc-omit] 9.2 Severe weather

If severe weather prevents the start of your booking, we will reschedule to a mutually agreed date within 12 months of the original booking. If no suitable date is agreed upon within that period, prepayments will be forfeited.

If part of your race package is postponed mid-session due to severe weather, you will receive a credit for the unused portion. Credits are processed within 7 business days and applied to your membership profile. Credits are non-transferable and cannot be redeemed for cash.

Interstate and international visitors may receive a proportional refund where Ace Karts determines that a credit or reschedule is not practical.

10. Mechanical issues, operational stoppages and race interruptions

Karts are mechanical vehicles and may occasionally be affected by mechanical or operational issues. Ace Karts may stop, pause, shorten, restart, or reschedule a race session where required for safety, mechanical, track, weather, or operational reasons.

Where Ace Karts determines that a customer has not received the service paid for due to a fault within Ace Karts’ control, Ace Karts may offer a restart, replacement session, credit, refund, or other remedy at its discretion, subject to any rights that cannot be excluded under Australian Consumer Law.

11. Customer behaviour and refusal of service

Ace Karts may refuse entry, refuse participation, stop a session, remove a customer, or cancel a booking where a customer or attendee behaves in a way that is unsafe, abusive, aggressive, threatening, discriminatory, intoxicated, dishonest, disruptive, or contrary to Ace Karts’ instructions, policies, or safety requirements.

No refund, credit, postponement, or fee waiver will apply where service is refused or cancelled due to customer conduct.

12. Damage to property

Customers are responsible for damage they deliberately, recklessly, negligently, or improperly cause to Ace Karts property, karts, equipment, facilities, or third-party property. Ace Karts may seek recovery of reasonable repair, replacement, cleaning, or associated costs where damage is caused by customer conduct or failure to follow instructions.

13. Minors and supervising adults

A parent, legal guardian, or authorised supervising adult must ensure that minors understand and follow all safety rules, staff instructions, and participation requirements.

A parent, legal guardian, or authorised supervising adult must remain on site at Ace Karts while the minor is participating. Minors must not be left at Ace Karts without appropriate adult supervision.

Ace Karts may refuse participation to a minor where appropriate consent, supervision, registration, or safety compliance is not provided.

Where an adult makes a booking on behalf of a minor or group, that adult confirms they have authority to do so and accepts responsibility for communicating these Terms and all safety requirements to the participants.

14. Personal belongings

Customers are responsible for their own personal belongings. Ace Karts is not responsible for lost, stolen, misplaced, or damaged personal items except where liability cannot be excluded by law. Customers must not take loose items, phones, or valuables onto the track or into a kart.

15. Website, booking information and customer details

Customers are responsible for providing accurate booking, contact, driver, and payment information. Ace Karts is not responsible for issues caused by incorrect details, missed messages, incorrect arrival times, or failure to check booking confirmations.

Website content, availability, prices, packages, images, session times, and product descriptions are provided in good faith but may change without notice. Ace Karts may correct errors, cancel affected bookings, or provide reasonable alternatives where an obvious error has occurred.

16. Privacy and communications

Ace Karts collects and uses customer information for purposes including bookings, safety, membership profiles, customer service, marketing, payment processing, incident management, and operational requirements. By making a booking or registering with Ace Karts, you agree to receive booking-related communications and service messages.

Marketing communications may be sent where permitted. Customers may unsubscribe from marketing communications where an unsubscribe option is provided.

17. Photography, video and promotional use

Ace Karts may capture photography, video, CCTV, or other recordings for safety, security, operational, training, incident management, and promotional purposes. If you do not wish to appear in promotional content, you should notify Ace Karts before participating.

18. Liability and Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights, guarantees, warranties, or remedies that cannot be excluded, restricted, or modified under the Australian Consumer Law or any other applicable law.

To the maximum extent permitted by law, Ace Karts is not liable for indirect, consequential, incidental, special, or economic loss, including loss of opportunity, travel costs, accommodation costs, missed appointments, loss of enjoyment, or loss arising from delays, rescheduling, refusal of participation, customer conduct, weather, or circumstances outside Ace Karts’ reasonable control.

Where Ace Karts is permitted to limit its liability, its liability is limited, at Ace Karts’ option, to resupplying the service, providing an equivalent service, providing a credit, or refunding the amount paid for the affected service.

19. Events outside our control

Ace Karts is not liable for failure or delay in providing services where caused by events outside its reasonable control, including severe weather, power failure, system outage, emergency, government direction, safety incident, natural disaster, supplier failure, industrial action, or other circumstances beyond Ace Karts’ control. In these circumstances, Ace Karts may reschedule, provide a credit, or take other reasonable steps at its discretion.

20. General

If any part of these Terms is found to be invalid, unlawful, or unenforceable, the remaining parts continue to apply. A failure by Ace Karts to enforce any right or provision does not waive that right or provision.

These Terms are governed by the laws of Victoria, Australia. Any dispute is subject to the courts and tribunals with jurisdiction in Victoria, Australia.
